Experienced Lawyers with a focus on Preventative Law
We are experienced lawyers on a mission to help our clients in Vancouver and the Tri Cities area to anticipate legal problems before they arise. Individuals and business owners find themselves in situations on a daily basis that could become costly legal disputes. The preparation and planning needed to avoid such legal disputes requires focused and clear legal advice. There are many examples of preventative law and how it can work for you.
Marriage breakdown and divorce will usually go much more smoothly and be less stressful if the parties know their rights and obligations before they start taking positions about what they feel they are entitled to or should have to pay or give up. Hardened positions usually result in numerous costly court appearances from which no one emerges unscathed.
An employer is unlikely to face a wrongful dismissal lawsuit if the employer has been advised not only about the employer’s rights and obligations when it comes to terminating the employment of an employee, whether for cause or not, but also about the appropriate manner in approaching and carrying out the termination before it is scheduled.
A strata corporation will be less likely to incur the expense of a lawsuit if it has legal advice about how it should be interpreting the Strata Property Act and its own strata by-laws and rules so that it can, for example, take supportable action against an offending owner or tenant or avoid taking improper action for which it will be called to task later on. Strata councils are usually made up of regular people who volunteer what extra time they have to serve on council; legal disputes are not only costly from a financial perspective but from an emotional perspective. It causes stress to everyone involved when a conflict escalates and threats rather than solutions are exchanged. A problem-solving, positive approach taken early on will also help maintain relationships rather than destroy them. “You can just sell and move away” is neither reasonable nor feasible for most people and does not help to resolve the issues which will likely arise again with another owner or council.
The preventative law approach can be applied to most situations where a legal problem or dispute may arise.
